A grand jury is a group of citizens selected for court service to decide whether a person should be formally accused of a crime. In Ohio, prosecutors are required to use grand juries in felony cases.

The primary function of the grand jury is to hear testimony and review evidence. Typically, only the prosecutor's side is presented, and grand juries almost always return indictments.

Grand juries do not decide the merits of the case, and they do not make a determination of guilt or innocence.

 

When a grand jury believes a crime has been committed, they return indictments, which are simply documents stating the offense and the person accused.

When they decide that no offense took place, this is called a "no-bill".

Grand jury proceedings are secret, and are normally held without the presence of the suspect or his criminal defense lawyer.

Indictments often remain secret until the accused person has been served with a copy. This is why the charges may not appear in the court records prior to the accused person being arrested.
